Principes généraux
Under s. 522 only a superior court justice may consider the release of someone charged with an offender under s. 469.[1]
- Interim release by judge only
522 (1) Where an accused is charged with an offence listed in section 469 [Infractions pertinentes d'une compétence exclusive], no court, judge or justice, other than a judge of or a judge presiding in a superior court of criminal jurisdiction for the province in which the accused is so charged, may release the accused before or after the accused has been ordered to stand trial.

(2) Where an accused is charged with an offence listed in section 469 [Infractions pertinentes d'une compétence exclusive], a judge of or a judge presiding in a superior court of criminal jurisdiction for the province in which the accused is charged shall order that the accused be detained in custody unless the accused, having been given a reasonable opportunity to do so, shows cause why his detention in custody is not justified within the meaning of subsection 515(10) [justification de la détention sous garde].

- Release of accused
(3) If the judge does not order that the accused be detained in custody under subsection (2) [ordonner la détention pour infractions à l'art. 469 à moins que l'accusé ne présente une raison], the judge may make a release order referred to in section 515 [dispositions relatives à la mise en liberté provisoire par voie judiciaire].
- Order not reviewable except under section 680
(4) An order made under this section is not subject to review, except as provided in section 680 [révision par la cour d'appel].
- Application of sections 517, 518 and 519
(5) The provisions of sections 517 [Ordonnance ordonnant que des éléments ne soient pas publiés pendant une période déterminée], 518 [Inquiry to be made by justice and evidence] except subsection (2) [libération sur plaidoyer de culpabilité en attendant la sentence] thereof, and 519 [libération de l'accusé après une audience de justification] apply with such modifications as the circumstances require in respect of an application for an order under subsection (2) [ordonner la détention pour infractions à l'art. 469 à moins que l'accusé ne présente une raison].
- Other offences
(6) Where an accused is charged with an offence mentioned in section 469 [Infractions pertinentes d'une compétence exclusive] and with any other offence, a judge acting under this section may apply the provisions of this Part [Pt. XVI – Mesures concernant la comparution d’un prévenu devant un juge de paix et la mise en liberté provisoire (art. 493 à 529.5)] respecting judicial interim release to that other offence.

- Onus
The onus is upon the accused to show cause for release on a 469 offence.[2]
- Detention by Provincial Court Judge
A person charged with an offence under s. 469 will be required to attend before a justice of the peace or provincial court judge under s. 503, however s. 515(11) requires them to detain the accused.

- Detention in custody for offence listed in section 469
(11) Where an accused who is charged with an offence mentioned in section 469 [Infractions pertinentes d'une compétence exclusive] is taken before a justice, the justice shall order that the accused be detained in custody until he is dealt with according to law and shall issue a warrant in Form 8 [formes] for the committal of the accused.

(2.1) A judge referred to in subsection (2) [ordonner la détention pour infractions à l'art. 469 à moins que l'accusé ne présente une raison] who orders that an accused be detained in custody under this section may include in the order a direction that the accused abstain from communicating, directly or indirectly, with any victim, witness or other person identified in the order except in accordance with such conditions specified in the order as the judge considers necessary.
