He had also already pleaded guilty to offences arising out of his arrest the next day when he was found in a vehicle with the same handgun he had used the previous day, but reloaded, tucked into his waistband. For those offences, the Court had imposed the jointly recommended sentence of five years in custody in addition to four months of pre-trial custody. The appeal court did not interfere with the judge’s discretion to order that the sentences for the offences arising out of the shooting be served concurrently to the sentences for the offences arising out of the arrest."
